1. Agreement and who we are

SoberHub is a California Nonprofit Public Benefit Corporation (Entity No. 6561452) and a 501(c)(3) public charity, located at 603 Lake St, Huntington Beach, CA 92648, United States (“SoberHub”, “we”, “us”).

These Terms of Service (“Terms”) apply to the SoberHub mobile app for iOS and Android (including beta builds), the website soberhub.life, and the share pages at share.soberhub.life (together, the “Services”). By creating an account, signing in, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

2. Who may use SoberHub, and accounts

Age. You must be at least 13 years old to create an account; 14 if you live in Quebec; and 16 if you live in the European Union or the European Economic Area, because SoberHub does not offer a parental-consent process. If you are under 18, we encourage you to involve a parent, guardian or another trusted adult, and where the law requires a parent’s permission for you to download or use apps (for example through your app store’s parental-consent process in some U.S. states), you may use the Services only with that permission. App store age ratings describe content and are not the minimum age to use SoberHub. We do not currently verify age, but if we learn, including from information you give us, that an account belongs to someone below the required age, we will close it and delete its data. Whatever your age, and with or without an account, the resources in section 3 are open to you.

Accounts. You can sign up with an email address, sign in with Apple, Google or Facebook, or continue as a guest. A guest account is tied to a random identifier stored on your device: if you delete the app or lose the device, you lose access to that account and its notes and bookmarks, and we cannot recover it. You are responsible for keeping your credentials confidential and for what happens under your account. Please give us accurate information and keep it up to date.

One person, one account. Do not use another person’s account or let another person use yours.

3. What SoberHub is and is not

SoberHub is an educational e-reader, audiobook and meeting-finder app for recovery literature, with a sobriety counter, notes and bookmarks. It is built around the literature and meetings of twelve-step fellowships.

SoberHub is not a healthcare provider, a treatment program, a therapist, a sponsor or a crisis service; it is not a medical device and does not diagnose, treat, cure or prevent any medical condition; and it is not affiliated with any fellowship. Nothing in the Services is medical, psychological or legal advice, and nothing replaces professional care or a meeting. Recovery decisions are yours, ideally made with people who know you.

If you need help now. If you are in immediate danger, call your local emergency number. In the United States and Canada you can call or text 988 (Suicide and Crisis Lifeline) at any time. In the United States, the SAMHSA National Helpline, 1-800-662-4357 (HELP), is free, confidential and open around the clock for people facing substance-use problems, and 211 connects you to local services. Elsewhere, findahelpline.com lists crisis lines by country.

4. Free, nonprofit, no ads

The Services are free. There are no fees, subscriptions, in-app purchases or advertisements, and we do not sell your information. SoberHub is funded by donations and grants. We may change or discontinue features, and we may limit use of the Services to keep them working for everyone.

SoberHub is and will remain a nonprofit. If we ever merge with, or transfer the Services to, another nonprofit, we will give you at least 30 days’ notice and the chance to delete your account first, and the recipient must honor these Terms and the Privacy Policy or ones at least as protective.

5. Your content

You own your content. Your notes, highlights, bookmarks, profile information and feedback (“your content”) remain yours. You give us a non-exclusive, worldwide, royalty-free license to store, copy, display and transmit your content only as needed to run the Services for you: to sync it between your devices, to show it to you, and, for items you choose to share, to display them on the public share pages until they are removed. We claim no other rights in your content and we do not use it to train artificial-intelligence models.

Feedback. If you send us ideas or suggestions, you agree that we may use them without any obligation to you.

Your responsibility. You confirm that you have the right to post your content and that it does not violate anyone’s rights or the law.

6. Sharing and public pages

When you tap “Share” on a note, bookmark, passage or milestone, the app creates a public web page on share.soberhub.life. Anyone with the link can open that page, and search engines may index it. A shared note or bookmark shows your nickname (or “Anonymous”), the book and chapter, a short quote, and any note text. The link contains your user ID.

There is currently no way to un-share a single note or bookmark, and deleting the note in the app does not disable the page. All of your shared pages stop working when you delete your account. We plan to add per-item revocation; until then, share only what you are comfortable making public.

Do not share content that identifies other people without their permission. Anonymity is a foundation of twelve-step fellowships; please respect it for others as you would want it respected for you.

7. Literature, audio and other third-party content

7.1 Alcoholics Anonymous literature

A.A. literature such as the Big Book, Twelve Steps and Twelve Traditions, Daily Reflections and Living Sober (“A.A. Materials”) is made available under A.A.’s Terms of Use. When you choose to read a book, the app downloads it from aa.org to your device, after you confirm that you accept those terms, for your personal, non-commercial use. We do not claim ownership of A.A. Materials, and your use of them must comply with A.A.’s Terms of Use and applicable copyright law. If you believe any content in the Services is used in a way that infringes someone’s rights, contact us (section 19).

Excerpts. The share feature limits shared passages to a short excerpt, and shared pages link to the location in the book rather than reproducing it. The copy feature does not limit length; what you do with copied text is your responsibility under A.A.’s Terms of Use and copyright law. Do not try to bypass the excerpt limit.

7.2 Trademarks and non-affiliation

“Alcoholics Anonymous”, “A.A.”, “The Big Book” and related names and logos are trademarks of their owners and are used in the Services only to identify the literature and meetings they refer to. SoberHub is not affiliated with, approved by, or endorsed by Alcoholics Anonymous World Services, Inc., the General Service Office of A.A., or any other fellowship, intergroup or group. “SoberHub” and our logo are our own marks.

7.3 Audio

  • Some audio in the Services may be produced with synthetic (AI) voices. No real person’s voice is imitated. Synthetic narration can mispronounce or misread words; the printed text prevails.
  • The Joe & Charlie Big Book Study recordings are recordings of talks given by Joe McQ. (d. 2007) and Charlie P. (d. 2011) at their 1998 workshops. They are not official literature of any fellowship and are not endorsed by any fellowship or its publishers. SoberHub does not claim any rights in these talks or recordings and does not sell them. We share them free of charge, as they have long been shared within the fellowship, and we have lightly remastered the audio for clarity. If you hold rights in these talks or recordings, contact legal@soberhub.life (section 19); we will remove the material within 5 business days of a credible request while we review it, or credit you as you prefer.

7.4 Meeting directories and maps

Meeting listings come from public third-party meeting directories. Maps and address search are provided by Mapbox and its data providers, including OpenStreetMap contributors. Meeting information belongs to the groups and organizations that publish it; we relay it and may cache it, and we do not verify it (section 8). You may use meeting information only to find and attend meetings, not to compile databases, contact groups for commercial purposes, or interfere with any group. SoberHub is not affiliated with any meeting directory, fellowship, intergroup or group.

7.5 Other third-party content and links

Prayers, historical texts and other material are attributed on the pages where they appear. The Services link to other websites and services (aa.org, the app stores, YouTube, crisis lines and others) that we do not control; their terms and privacy policies apply to your use of them.

7.6 Our own content

The design, software, text, artwork and other material that SoberHub itself created are owned by SoberHub or its licensors and protected by copyright and other laws. You may use them only as part of the Services under section 10.

8. Meetings information

Meeting times, places, formats and links are entered by volunteers around the world and change often. We do not verify them and cannot guarantee that a meeting exists, is open, is at the listed address, or is what it is described to be. Please confirm details before travelling, use ordinary caution when attending any in-person or online meeting, and tell the group or intergroup, not us, when a listing is wrong. Twelve-step groups are autonomous; we have no authority over any group or meeting.

9. Acceptable use

You agree not to:

  • create or use an account if you are below the minimum age in section 2, or give a false date of birth or country to get around it;
  • use the Services for any commercial purpose, including selling, renting or advertising anything to other users, without our written permission;
  • reproduce, redistribute, publicly perform or create derivative works of A.A. literature or other third-party content beyond what section 7 and the content owners’ terms allow;
  • scrape, crawl, bulk-download or otherwise extract literature, audio, meeting data, shared pages or other content from the Services or our content servers, whether by hand or with automated tools;
  • circumvent excerpt limits, access controls or any other technical protection in the Services;
  • reverse-engineer, decompile or disassemble the app, except where the law gives you that right regardless of this clause;
  • access another person’s account or data, or probe, scan or test the security of the Services without our written permission;
  • upload malware, or interfere with the Services, our servers or the third-party services the app relies on;
  • impersonate any person, group or organization, or misrepresent your affiliation;
  • post content that is unlawful, harassing, threatening, hateful, or that discloses another person’s identity or recovery status without their consent;
  • use meeting information or shared pages to harass, stalk or identify anyone;
  • use the Services in violation of any applicable law.

We may remove content and suspend or terminate accounts that violate these rules.

10. Our license to you, and the app stores

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, and to use the website and share pages, for your personal, non-commercial use. All rights not expressly granted are reserved.

Automatic downloads. The app downloads content and audio to your device as you use its features, and updates them when they change. You can free space by deleting books in the app or by deleting the app.

Apple and Google. If you obtained the app from Apple’s App Store or Google Play, the store’s terms also apply, and where they conflict with these Terms in a way that protects the store, the store’s terms prevail. Apple and Google are not responsible for the app, its content or support, and have no obligation to provide maintenance. Apple, Google and their subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not in a country subject to a U.S. government embargo or designated as “terrorist supporting”, and that you are not on any U.S. government list of prohibited or restricted parties.

Beta builds. TestFlight and Google Play beta versions may be unstable and may change or stop working at any time. Please do not rely on them for anything you cannot afford to lose.

11. Privacy

Our Privacy Policy explains what information we collect, how we use it, who we share it with, and your rights. It is part of these Terms. Please read it: it is written to be honest about what the app and website do today, including analytics that are on by default and the sharing features described in section 6.

12. Ending your account or these Terms

By you. You can delete your account at any time in the app (Profile → Danger Zone → Delete account) or by emailing support@soberhub.life. Your profile, notes and bookmarks are permanently deleted after a 30-day grace period during which signing in restores the account; the Privacy Policy explains what persists longer. You can stop using the Services at any time.

By us. We may suspend or terminate your access, or remove content, if you violate these Terms, if the law requires it, or if we discontinue the Services. Where reasonable we will tell you and give you a chance to fix the problem or export your content.

Sections 5 (for shared content still displayed), 7, 13, 14, 15, 16 and 18 survive termination.

13. Disclaimers

The Services are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and any warranty that the Services will be uninterrupted, error-free, secure or accurate.

In particular: literature and audio may contain errors, including in synthetic audio; meeting information may be wrong or out of date; the sobriety counter and milestone notifications depend on the date you entered and on your device’s clock; and search results are produced by software and may miss relevant passages.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

14. Limitation of liability

SoberHub is a small charity that provides the Services for free. To the fullest extent the law allows:

  • SoberHub and its directors, officers, volunteers and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, goodwill or opportunity, arising from or related to the Services, even if we were told such damages were possible; and
  • our total liability for all claims relating to the Services is limited to US $100.

These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer-protection law in your country or province. If you are a consumer in the European Union, the United Kingdom, Quebec, Brazil or another jurisdiction with such laws, you keep the rights those laws give you. If you are a consumer residing in Brazil, nothing in these Terms limits the rights you have under the Consumer Defense Code or the Marco Civil da Internet, and the limitation above applies only to the extent Brazilian law permits.

15. Your responsibility for misuse

If a third party makes a claim against SoberHub because you violated these Terms, infringed someone’s rights, or misused literature, audio, meeting data or the sharing features, you agree to compensate SoberHub for the resulting losses and reasonable legal costs, to the extent the law where you live allows.

16. Governing law and disputes

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law rules, except where the mandatory law of your country or province applies instead.

Talk to us first. If you have a problem, email legal@soberhub.life and we will try to resolve it informally within 30 days.

Courts. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Orange County, California, and you and we consent to their jurisdiction. If you are a consumer, you may instead bring a claim in the courts of your place of residence where the law gives you that right. If you live in Quebec, nothing in these Terms deprives you of the protection of the mandatory rules of Quebec law, and you may bring proceedings before the courts of Quebec. If you live in Brazil, you may bring proceedings before the courts of your domicile. These Terms do not require arbitration and do not waive your right to bring a class action.

17. Changes to these Terms

Each version of these Terms has a version number and an effective date, shown at the top. We may change the Terms as the Services or the law change. For material changes we will notify you in the app or by email at least 14 days before they take effect, unless a change is needed sooner for legal or security reasons. If you keep using the Services after the effective date, the new Terms apply; if you do not agree, delete your account before then. Previous versions are available on request.

18. General terms and language

  • Entire agreement. These Terms, the Privacy Policy and any additional terms we present for a specific feature are the whole agreement between you and SoberHub about the Services.
  • Severability and waiver. If a court finds a provision unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours only to another nonprofit as described in section 4.
  • No third-party rights, except for Apple and Google as stated in section 10.
  • Language. These Terms are published in English, Spanish, French, Portuguese and Russian, and we keep all versions equally complete. If the translations differ, the English version applies, except where the law of your place of residence says otherwise: residents of Quebec may rely on whichever of the French and English versions is more favourable to them, and consumers in Brazil may rely on the Portuguese version.

19. Copyright complaints

If you believe that content in the Services infringes your copyright, send a notice to our designated agent: SoberHub, Attn: Legal, 603 Lake St, Huntington Beach, CA 92648, United States, legal@soberhub.life. A notice must include: (1) your physical or electronic signature; (2) identification of the work you believe is infringed; (3) identification of the material and where it is (for example the share link); (4) your contact details; (5) a statement that you have a good-faith belief that the use is not authorized by the owner, its agent or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are the rights holder or authorized to act for them. We will respond promptly and remove or disable access to the material.

Counter-notice. If your content is removed, you may send a counter-notice with your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that it was removed by mistake or misidentification, your name, address and phone number, and your consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any district where SoberHub may be found) and to accept service from the person who complained. We may restore the material in 10 to 14 business days unless that person tells us they have filed suit.

Repeat infringers. We will disable sharing for, and in appropriate circumstances terminate, the accounts of users who repeatedly infringe. Knowingly false notices or counter-notices may create liability under 17 U.S.C. §512(f).
